CCJ approves bill which hampers dismissal of pregnant women

On Wednesday (3), the Committee on the Constitution and Justice and Citizenship (CCJ), approved the Bill 95/03, authored by Deputy Paulo Rocha (PT-PA), which allows the just- cause dismissal of pregnant women only after the verification of a serious misconduct by means of a judicial inquiry. According to the bill, the worker should be remunerated during the procedure of that inquiry. That measure is valid only to workers registered according to the Consolidated Labor Laws (Decree-Law 5.452/43).

That bill was approved in conclusive character and, if there is no appeal, will be forwarded to the Senate.

Tranquility
According to the author of that bill, the employment guarantee will give more tranquility to the pregnant worker and prevent losses due to delays in the conclusion of inquiries.
Its rapporteur, Deputy Flávio Dino (PCdoB-MA), agreed with Rocha’s arguments and presented a favorable review to the bill. “We have strengthened the protection to the pregnant worker. There is already stability for her, but there is no protection, if the employer accuses her of having committed a serious misconduct, and dismisses her for that. With that bill, if the employer considers that the employee has committed a serious misconduct during her pregnancy, he should go to Court to obtain the decision authorizing that dismissal”, explained Dino.

That bill was approved as a substitution bill by its rapporteur, who adjusted its legislative technique, without changing the measure provided for.
