Committee on Labor facilitates visa issue for temporary labor

The Committee on Labor, Administration and Civil Service approved on Wednesday (15) the Bill 2594/07, from member of the chamber, William Woo by the Brazilian Social Democracy Party of São Paulo, which facilitates the permanence in Brazil of the foreign people, even without employment relationship, that comes with any of the following skills:
- to attend legal entity of private right in emergency situation;
- to transfer technological knowhow;
- to provide technical assistance;
- to train people.

According to the project, this foreign person will have the right to a temporary visa and labor authorization for up to 90 days, just by presenting a copy of the passport; proof of the professional education; receipt of the individual immigration tax collection; and a copy of the statute or constitutive act of the legal entity, with proof of inscription on the Corporate Taxpayer Registration Number (CNPJ).

The purpose is to become visa concession less bureaucratic “granting the country with a more agile and consentaneous legislation with the globalized world”, states the proposal’s author.

Ship repair
“Indeed, in the current globalized world, the utilization of specialized foreign workforce is unavoidable by companies of all the economic industries for the accomplishment of services of temporary nature, for the transference of technology and staff training”, states the rapporteur, member of the chamber, Andreia Zito by the Brazilian Social Democracy Party of Rio de Janeiro-RJ, who classified the difficulties imposed by the effective legislation as “anachronistic”.

The rapporteur introduced in the bill an amendment aiming to eliminate problems in the emergency entry in the country of technicians sent by cruise liners or ship insurance companies to accomplish repair or maintenance services.

Considering that in many occasions the coming of this technician is decided in a weekend - or in some other situation - in which the previous contact with the Brazilian consulate in the city of origin is not possible, the rapporteur included in the text an authorization in order to make necessary only a cruise liner letter explaining the reasons of the trip and the estimated time of permanence.

In the same way, in the event of an emergency need of repair in the ship, the amendment allows that the maritime agent presents to the Federal Police, when arriving at the airport, a letter in the same terms, requesting a standard term of permanence of 15 days.
