Production of new car models can be obligatory for 3 years

The Bill 4146/08, from Deputy Eliene Lima (PP-MT), obliges car assemblers and producers to trade, for at least three years, new car models. In that period of time, at least 80% of the cars’ features, components and configurations must be maintained.

The congressman reports it is common that car assemblers launch new models and soon change their features and configurations. “That practice is extremely harmful to consumers, since the product they have acquired is depreciated and they lose the guarantee to easily replace parts or adequate components”, he argues.

According to Eliene Lima’s evaluation, despite the Consumers’ Defense Code, a specific regulation is necessary to standardize the production and trade of vehicles. “Those are extremely valuable goods, and consumers sacrifice a lot to acquire them”, he affirms.

Penalty
If the bill is approved, car assemblers and producers which do not comply with it will be subject to the suspension of their commercial activities until the production of the model is resumed; and they will be liable for losses and damages caused to purchasers.

Procedure
The bill, which is being processed in conclusive character, will be analyzed by the Committees on Consumer Protection; on Economic Development, Commerce and Industry; and on the Constitution, and Justice and Citizenship.
