Leticia (Colombia) and Tabatinga (Brazil), a unique town, divided by a street

The Committee on Constitution and Justice and Citizenship (CCJ) approved on Tuesday (1st) , the text of the agreement between Brazil and Colombia to create a zone of special border regime which covers the towns of Tabatinga, Brazil, and Leticia in Colombia.

The agreement, subject of the Proposal of Legislative Decree Nº 1972/09, from the Committee on Foreign Relations and National Defense, stipulates a special tax system to apply to trade in goods for consumption only in those cities.

The rapporteur, Deputy Mauro Benevides (PMDB-CE), recommended approval of the project. He noted that the text describes as beneficiairies those persons legally entitled to sell goods in accordance with the laws of each country.

The special system is extended to non-resident traders, who import quantities compatible with their needs. There will be exemption from federal taxes levied on foreign trade operations, in the case of Brazil, and customs taxes in Colombia.

No bureaucracy
The special regime exempts authorized dealers from registration, licensing or any visa, permit or certification other than the application of sanitary laws and environmental regulations. The authorities may exercise control to ensure compliance with the rules of the agreement, by means of inspection, when they deem it necessary.

A simplified customs clearance on imports and exports is also established, based on commercial bills or invoices, preferably by electronic means. Payments of taxes and the consolidated customs declaration will be monthly, based on invoices and receipts for the period.

Procedure
The proposal, subject to review by the Floor, is being processed under urgency, and it will also be examined by the committees on Economic Development, Industry and Trade; and Finance and Taxation, which will also analyse it on its merits.
