Provisional Measure on Charities receives 268 amendments

The Provisional Measure MP 446/08, which allows charities to be exempt from social-security contributions, received 268 amendments from the congresspeople until the end of the term for suggestions, on Monday
(11/17).

Known as the Charities’ Provisional Measure, it changes the rules for concession and renewal of Cebas (Certification of Social-Service Charitable Organization) . Cebas currently expires in three years. According to the Provisional Measure, the certificate will have a variable validity period, from one to three years, according to the specificities of each area.

The Provisional Measure dismisses all processes questioning renewals, and makes the approval of all charity certificates waiting for renewal at the National Council of Social Service (CNAS) automatic.

Since its enforcement, on November 10, 2008, the Provisional Measure provoked polemics, because it pardons the organizations, including those suspect of irregularities and which were denounced during an operation of Federal Police in March 2008. The government argues that it lacks structure to judge all processes.

The Provisional Measure 446/08 starts to lock the agenda of the House in which it is processed from February 24th, 2009 on.
