Establishing the number of deputies

Establishing the number of deputies

>
The Federal Constitution, in its article 45, determines that the total number of deputies, as well as the representation by state and by the Federal District must be established by complementary law (1), proportionally to the population. Necessary adjustments must be made in the year preceding the elections so that none of the states of the Federation will have less than eight or more than seventy deputies.

The complementary law nº 78, of 12/30/1993, establishes that the number of deputies may not exceed five hundred and thirteen representatives. Statistic data will be provided by the Fundação Instituto Brasileiro de Geografia e Estatística (Geography and Statistics Brazilian Institute Foundation).

The Higher Electoral Court will provide the Regional Electoral Courts and the political parties with the number of seats to be under dispute.

Besides the minimum number of representatives, the law also determines that each Federal Territory will be represented by four federal deputies.
